The collection of the pay data for calendar years 2017 and 2018 will begin in mid-July 2019, with a Sept. 30, 2019 deadline.

The Equal Employment Opportunity Commission (EEOC) has announced that EEO-1 report filers should begin preparing to submit pay data for calendar years 2017 and 2018 by Sept. 30, 2019.

Background

The EEO-1 report is an annual government survey that must be filed by all private employers with 100 or more employees, and employers with federal government contracts of $50,000 or more who have 50 or more employees. Affected employers must provide a count of their employees by job category and then by ethnicity, race, and gender (Component 1 data).

Component 2 pay data

In 2016, the EEO-1 report was expanded to collect pay data (Component 2 data). This was placed on hold since 2017 by the Office of Management and Budget (OMB) and was recently reinstated by order of a federal judge in Washington D.C. The EEOC said it could collect this information by Sept. 30, 2019.

The federal judge issued a subsequent order approving the Sept. 30, 2019 deadline, but also gave the EEOC the option to collect either calendar year 2017 and 2018 pay data; or 2018 and 2019 pay data. If the latter was chosen, the deadline would have been extended for the calendar year 2019 pay data. The deadline for this decision from the EEOC was May 3, 2019.

EEOC to collect pay data for 2017 and 2018

On May 3, 2019, the EEOC complied with the court order and posted that it would be collecting Component 2 pay data for calendar years 2017 and 2018. The notice explains that employers required to file the EEO-1 report should begin preparing to submit the Component 2 pay data. Collection is expected to begin in mid-July 2019.  Filers will be notified of the precise date as soon as it is available. The deadline for this pay data collection is Sept. 30, 2019.

EEO-1 report filers should continue to use the currently open EEO-1 portal to submit Component 1 data from 2018 by May 31, 2019.
